1. Purpose
These terms govern access to and use of the Whale Tracker service (“the Service”), whether through the free channel or the premium subscription.
Using the Service, including its free tier, constitutes acceptance of these terms.
2. Description of the service
Whale Tracker is an automated tool that monitors futures markets and issues notifications when it detects a price move accompanied by an abnormal rise in volume.
Alerts are broadcast on Discord (free access, with a broadcast delay) and on Telegram (premium access, in real time).
The detection method, its parameters and its thresholds constitute the publisher's know-how and are not disclosed.
3. Subscription, price and cancellation
The premium subscription is offered at €29 per month, renewed automatically until cancelled.
Payment is processed by Stripe. The publisher neither collects nor stores any card details.
The subscription can be cancelled at any time. Access remains open until the end of the period already paid for; no pro-rata refund is issued.
Under French consumer law (Code de la consommation, art. L221-28 13°), the right of withdrawal does not apply to digital content not supplied on a physical medium whose performance has begun after the subscriber's express prior agreement and express waiver of that right. This waiver must be collected explicitly before premium access is opened, separately from acceptance of these terms as a whole.
4. Not investment advice
The Service provides automated, technical information. It does not constitute investment advice, a personalised recommendation, or a portfolio management service.
The publisher is not a regulated investment services provider and executes no orders on behalf of users.
Each user remains the sole decision-maker and bears sole responsibility for the trades they place. Trading crypto-assets carries a risk of total capital loss.
5. Availability
The Service is provided “as is”. No guarantee is given as to continuous availability, completeness, or accuracy of the alerts.
Interruptions may occur due to maintenance, failure, or unavailability of third-party data sources or broadcast platforms.
6. User conduct
Reselling, rebroadcasting or sharing premium alerts with third parties is prohibited and results in immediate termination of the subscription without refund.
Abusive language, harassment and unsolicited promotion are prohibited on the broadcast channels.
7. Intellectual property
The Whale Tracker name, its visual identity, the bot's source code and the detection method remain the exclusive property of the publisher.
The subscription grants a personal, non-transferable right of access to the content broadcast, and no other right.
8. Limitation of liability
The publisher cannot be held liable for financial losses, direct or indirect, resulting from decisions taken on the basis of the alerts broadcast.
In any event, the publisher's liability is limited to the amounts actually paid by the user over the preceding twelve months.
9. Governing law
These terms are governed by French law.
Failing an amicable resolution, any dispute falls within the jurisdiction of the French courts.
