Terms of service

The Service is published by Zendeurr, sole trader, operating under the trade name “Whale Tracker by Zendeurr”.

Registration of the sole trader business is in progress. The SIREN number and business address will be published in this section as soon as they are issued, in accordance with article 6-III of French law no. 2004-575 of 21 June 2004 on confidence in the digital economy.

These terms govern access to and use of the Whale Tracker service (“the Service”), whether through the free channel or the premium subscription.

Using the Service, including its free tier, constitutes acceptance of these terms.

Whale Tracker is an automated tool that monitors futures markets and issues notifications when it detects a price move accompanied by an abnormal rise in volume.

Alerts are broadcast on free channels (Discord and, where applicable, Telegram), with a broadcast delay, and on a premium Telegram channel, in real time.

The detection method, its parameters and its thresholds constitute the publisher's know-how and are not disclosed.

Three premium plans are offered, all taxes included:

Weekly plan — €24.99 per week, automatically renewed each week until cancelled.

Monthly plan — €79.99 per month, automatically renewed each month until cancelled.

Lifetime access — €284.99, paid once. This plan involves no renewal and no subsequent charge, and has no end date.

The weekly and monthly plans are paid by card through Stripe. Lifetime access is paid exclusively in cryptocurrency (Solana) through MakePay; it is not available for card payment.

The publisher neither collects nor stores any card details: these are handled exclusively by Stripe.

The applicable price is the one displayed on the payment page at the time of subscription. Any price change has no effect on periods already paid for.

The weekly and monthly plans can be cancelled at any time. Cancellation ends the renewal: access remains open until the end of the period already paid for, and no pro-rata refund is issued for the current period.

Lifetime access cannot be cancelled, as it involves no renewal. It remains open without time limit, subject to the continuation of the Service as set out in the “Availability and evolution of the Service” section.

The publisher may terminate access, without refund, in the event of a material breach of the obligations set out in the “User conduct” section.

Under French consumer law (Code de la consommation, art. L221-28 13°), the right of withdrawal does not apply to digital content not supplied on a physical medium whose performance has begun after the subscriber's express prior agreement and express waiver of that right.

This waiver is collected explicitly before premium access is opened, separately from acceptance of these terms as a whole.

Where that waiver has not been collected, the subscriber retains a period of fourteen days from the conclusion of the contract in which to withdraw.

The Service provides automated, technical information. It does not constitute investment advice, a personalised recommendation, or a portfolio management service.

The publisher is not a regulated investment services provider and executes no orders on behalf of users.

Each user remains the sole decision-maker and bears sole responsibility for the trades they place. Trading crypto-assets carries a risk of total capital loss.

The Service is provided “as is”. No guarantee is given as to continuous availability, completeness, or accuracy of the alerts.

Interruptions may occur due to maintenance, failure, or unavailability of third-party data sources or broadcast platforms.

Reselling, rebroadcasting or sharing premium alerts with third parties is prohibited and results in immediate termination of the subscription without refund.

Abusive language, harassment and unsolicited promotion are prohibited on the broadcast channels.

The Whale Tracker name, its visual identity, the bot's source code and the detection method remain the exclusive property of the publisher.

The subscription grants a personal, non-transferable right of access to the content broadcast, and no other right.

The publisher cannot be held liable for financial losses, direct or indirect, resulting from decisions taken on the basis of the alerts broadcast.

In any event, the publisher's liability is limited to the amounts actually paid by the user over the preceding twelve months.

These terms are governed by French law.

Failing an amicable resolution, any dispute falls within the jurisdiction of the French courts.
